Oppose SB 607 & CEQA Gutting

SB 607 (Wiener) is a sweeping rollback of our strongest environmental law, the California Environmental Quality Act (CEQA), that has protected us for over 50 years. As federal environmental laws come under attack, CEQA is the primary tool Californians have to protect our communities, environment, and public health against climate change impacts.

Join EAC and over 130 environmental groups in urging Senator Mike McGuire and Senator Anna Caballero to vote NO on this bill!

Why This Matters

Environmental Impact Reports (EIRs) are one of the pillars of CEQA and are critical in ensuring a project's significant impacts are vetted by the public and reduced. They ensure government transparency and accountability, promoting the public process in decision-making.

Currently, EIRs are required if there is "fair argument" that a project may have significant environmental impacts. However, SB 607 seeks to reverse this long-standing presumption. If SB 607 passes, even if there is solid, credible evidence that a project will cause significant impacts, an agency could refuse to prepare an EIR and instead uphold a negative declaration or mitigated negative declaration, if the agency can point to evidence suggesting otherwise.

Why EAC is Concerned

While SB 607 is being promoted as a bill that will streamline housing and clean energy projects, it would impact almost every private and government project in California, including freeways, airports, dams, railyards, shopping centers, sports complexes, power plants, prisons, and mining operations. 

Even presenting substantial evidence that a project would have harmful effects might not be enough to get needed impact analysis, opportunity for input from frontline communities, or consideration of project improvements.

Save the Endangered Species Act

Today is Endangered Species Day, but the Endangered Species Act (ESA) is under attack! In April, the U.S. Fish and Wildlife Service (USFWS) and the National Marine Fisheries Service proposed a significant weakening of the ESA by changing the definition of “harm” to no longer include changes to habitat.

Join EAC and comment by May 19 to protect the ESA and let the USFWS know you oppose this change!

Why This Matters

“Harm” has traditionally included changes to habitat, but this proposal would limit “harm” to only physical injury or death of individual animals.

Of course, this is a wildly narrow view of what harm to an animal means. Without habitat, wildlife do not have the food, water, shelter, and breeding grounds they need to survive. 

The ESA is 99% effective in preventing the extinction of listed species. This change to the ESA would dramatically reduce its ability to protect sensitive species and allow industry to destroy critical habitat.

Protect Monarch Butterflies

The U.S. Fish and Wildlife Service (USFWS) has proposed to add the monarch butterfly as threatened under the Endangered Species Act and has extended the public comment period until this Monday, May 19.

Monarchs are a high priority for EAC. We hosted an educational exhibit on monarchs, co-founded the Marin Monarch Working Group, and published Marin's Monarch Movement.

Join EAC and a myriad of environmental groups and concerned citizens and tell the USFWS that monarchs should be protected!

Why This Matters

Western monarchs have faced significant population decline since the 1980s - up to 99% have vanished. These butterflies are threatened by pesticides, loss of habitat and the milkweed they exclusively lay eggs on, and climate change.

The situation has only gotten more dire. Recent winter counts have found historic lows of just over 9,000 monarchs. The most recent monarch Species Status Assessment found that by 2080, the probability for western monarch extinction was 95%. 

It's not too late to act. The USFWS's proposal to add monarchs as threatened under the ESA would include species-specific protections to encourage butterfly conservation, as well as a critical habitat designation for overwintering grounds in coastal California. Extending critical federal protections to the monarch butterfly will be essential in the fight for their survival.
